1. Agreement to Terms

By accessing or using Treato Private Limited's ("Treato", "we", "our", or "us") mobile application, website, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

Treato provides a technology platform connecting patients with healthcare providers. Our Services include:

• Appointment booking and scheduling with healthcare providers
• Video and audio consultations with registered medical practitioners
• Medical record storage and management
• Health information, content, and social features
• Payment processing for healthcare services

3. User Accounts and Eligibility

To use certain features of our Services, you must create an account. You agree to:

• Be at least 18 years of age or have parental/guardian consent
• Provide accurate, current, and complete information
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

4. User Content and License

You may submit content through our Services, including reviews, comments, photos, and other materials ("User Content"). By submitting User Content, you grant Treato a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for:

• Operating and improving our Services
• Marketing and promotional activities
• Research and development of new features
• Training algorithms and machine learning models

This license continues even if you stop using our Services, to the extent your content has been shared with others or incorporated into our Services.

5. Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose
• Impersonate any person or entity
• Interfere with or disrupt the Services or servers
• Attempt to gain unauthorized access to any part of the Services
• Use automated means to access the Services without permission
• Post false, misleading, or defamatory content

7. Payments and Refunds

Certain Services require payment. By making a payment, you agree to:

• Pay all fees and charges associated with your use of the Services
• Provide accurate payment information
• Authorize us to charge your payment method for fees incurred

Refunds are subject to our Refund Policy and the cancellation policies of individual healthcare providers. Consultation fees may be non-refundable once a consultation has commenced.

8. Intellectual Property

The Services and all content, features, and functionality are owned by Treato or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Treato shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid to Treato in the twelve (12) months preceding the claim
• We are not liable for the acts, omissions, or conduct of any healthcare provider or third party

10. Indemnification

You agree to indemnify, defend, and hold harmless Treato, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses arising out of your use of the Services, violation of these Terms, or violation of any rights of another party.

12. Governing Law

These Terms shall be governed by the laws of India. Subject to the arbitration agreement above, any legal action shall be brought exclusively in the courts located in Hyderabad, Telangana, India.

13. Termination

We may terminate or suspend your account at any time, with or without cause or notice. Upon termination, your right to use the Services will immediately cease. Provisions that should survive termination shall survive, including ownership, warranty disclaimers, indemnification, limitation of liability, and dispute resolution.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Treato concerning the Services.
